Please read the terms and conditions below as they form a part of your contract with W10 Performance. If you accept these terms and conditions below, click the check box at the end and continue with your purchase of your onlinePT membership.


This Membership Contract sets out the Terms and Conditions of Membership and incorporates the W10 Performance Limited Rules (“the Rules”). Membership is subject to the Terms and Conditions and at all times conditional upon the member abiding by the Rules. Before committing to membership, you should read carefully this Membership Contract and the Rules.

We have made every effort to formulate the Membership Contract in easily understandable language and to make the documentation as simple as possible. Should you, however, have any questions regarding the meaning or effect of any part of the membership documentation, you should please raise them with a representative of W10 Performance Facility (“the Facility”).

In signing the membership application form you are entering this membership agreement that is a legally binding contract.

The W10 Performance rules

Membership Contract

Monthly rolling agreement, with a cancellation notice period of one calendar month


1.1           Applicants for membership shall be at least 16 years old.



2.1           The membership term shall begin on the date of acceptance by Management of W10 Performance.

2.2           The minimum membership term shall be 30 days

2.3           The membership runs as a monthly agreement, determinable with 30 days notice in writing.



3.1           A member shall pay the Subscription at the rates specified in W10 Performance’s current Literature in effect from time to time. If a Member wishes to re-join after leaving, the Initial Set Up fee will be payable.

3.2           The Subscription will be payable monthly orin advance subject to the following:

(i)             Payments shall be paid in advance by automated payment from the member’s designated debit or credit card in the instalments set out in W10 Performance’s current membership payment schedule. A member is not entitled to cancel their scheduled payments within or after 30day period without the prior notice or/and permission of the management of W10 Performance.

3.3           W10 Performance reserves the right to increase the Initial Set Up Fee and Subscription from time to time.

Members will be given not less than one month’s written notice of all increases in the Subscription.



4.1           W10 Performance reserves the right, at any time, to terminate or suspend the membership of any member where, in the view of the Management’s absolute discretion, there has been or is likely to be a serious breach of this Contract or the Rules or where any amounts due and owed to W10 Performance by the member have not been paid. In the event of such suspension or termination, no refund of Initial Set Up Fees or Subscription will be made by W10 Performance and all amounts owed and outstandingwill become immediately due and payable to W10 Performance.

4.2           W10 Performance has the right to prevent entry into the Facility by any member or former member whose membership has been suspended or cancelled.

4.3           Fraudulent or deceptive information given by a member to secure a membership will result in immediate termination of membership and any action deemed necessary by the Management of W10 Performance.



5.1           The member agrees to abide by the W10 Performance Rules, which form part of this Membership Contract.

5.2           The Management at W10 Performance may alter the Rules at any time. Alterations will be posted on the notice boards, which will constitute due notice of all such changes.



6.1           The Management at W10 Performance has the right to terminate or suspend a member’s membership for reasons relating to conduct as specified in the Rules.

6.2           The Management at W10 Performance reserves the right to prevent entry into or reject from the Facility anyone whose behaviour or appearance is, in its sole opinion, deemed by it to be unsuitable.



7.1           In applying for membership, the member warrants and represents that he/she is in good physical condition and that he/she is capable of exercise/activities in all the facilities and that such exercise/activities would not be detrimental to his/her health.

7.2           In registering a Guest at the Facility, the member warrants and represents that the guest is in a physical condition suitable for the type of exercise or activity in which the guest engages at the Facility. No guest may be admitted to the Facility without registration, which warrants the guest’s fitness.

7.3           Without in anyway limiting the scope and effect of the member’s warranty given in paragraphs 10.1 and 10.2 above, it is the member’s sole responsibility to bring to the attention of the Management at W10 Performance any medical condition that may present a risk to the member and/or to a member’s guest in engaging in any particular activity. Applicants’ attention is drawn to the Facility Rules.


8.              DATA PROTECTION

Personal information which you provide to W10 Performance in connection with your membership is held subject to and in accordance with the Data Protection Act 1998. This Act regulates the use of personal data and gives you various rights relating to the maintenance and use of that personal data.

Subject to W10 Performance receiving contrary notice fromyou,, W10 Performance may use the information you provide and any information relating to your Membership for the purpose of providing you with details of any products and services which may be of interest to you either by email or by telephone for general business purposes and marketing.

You have the right at any time to notify us that you wish us to cease using your personal information for either of the above purposes. We will comply with your request as soon as possible and use our reasonable endeavours to cease using the information no later than 40 days from our receipt of your notification.

You are entitled to a copy of the information we hold about you by writing to us and requesting it. There may be a fee for this service.


The W10 Performance‘Rules’ have been produced to ensure that all W10 members and online clients are assured of an enjoyable training experience. Although detailed in their nature, it is anticipated that for the majority of Members, there will be little or no need to ever refer to them. They do, however, allow the Management of W10 Performance Limited consistently to provide a quality service.

  1. Opening Hours

The Facility will open from 06;00 to 21:00 Monday to Friday, and 07:00 to 15:00 Saturday, with the exception of Christmas, New Year and official holidays, when these hours may vary.

  1. Because physical exercise can be strenuous and subject to risk of serious injury, we urge you to obtain a physical examination from a doctor before using any equipment or participating in any exercise activity.
  1. You agree that by participating in physical exercise or training activity, you do so at entirely your own risk.
  1. Any recommendation for changes in diet, including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes.
  1. Sessions Bookings & Cancellation Policy

5.1    There is a 24-hour cancellation policy. Bookings cancelled within 24 hours of the appointment may be charged 100% of the session fee. These fees are the sole discretion of the Facility Manager, whose decision shall be final.

5.2    Bookings are made through our online booking system.  If you have any problems please call 020 3489 5428 (if there is no answer please leave a message and we will get back to you within 24hrs), or email  Trainers and sessions are subject to change.

  1. Liability

6.1 W10 Performance’s liability for damage or loss to members’ or guests’ property is strictly limited to any damage or loss suffered as a result of negligence of W10 Performance, its staff or its agents. Management reserves the right, in its absolute discretion, to refuse to store any such personal property of members or guests. Property stored in lockers provided by the Facility is stored at the owner’s risk and no liability for loss or damage thereto will be accepted by W10 Performance.

6.2  W10 Performance will not accept any liability for any accident or injury (including any fatality) to any member, child, guest or visitor (including any person admitted to the Facility under the member’s membership) that may occur on the premises or within W10 Performance Facility’s grounds other than liability which may arise from the negligence of W10 Performance Facility, its staff or its trainers. Any member or guest who suffers an accident on W10 Performance’s premises or in W10 Performance’s grounds must report the accident and the circumstances under which it occurred, to the Management or the Duty Manager immediately following the accident.

  1. If a deposit has been paid and, due to you, training has not commenced within 4 weeks of the payment, the deposit will be deemed non-refundable.
  1. These terms are deemed to be accepted upon receipt of this document via email and without signature unless otherwise upon in writing by both parties.


Your personal information will be held and used in accordance with the Data Protection Act 1998. W10 Performance will not disclose such information to any unauthorised person or body but where appropriate will use such information in carrying out its various functions and services.

I hereby agree to the terms and conditions of membership in W10 Performance Membership Contract. I have read and understood the W10 Performance Limited Rules, and agree to them.
